Effective May 26, 2021. These terms and conditions apply to all orders placed by consumer customers via Phonebuddy on the Phonebuddy website. If you are not a consumer customer, please contact us at info@phonebuddy.com.

By placing an order, the Customer confirms acceptance of the terms and conditions set forth in this document. Before placing an order, please read these terms and conditions carefully.

Please note that Phonebuddy is not a representative of Apple and we are not an Apple Authorized Service Provider.

  1. Definitions

“Phonebuddy“ refers to ITP TRADING SRL (registration number: 09927411216, address Via Fedro 4 - 80122 Naples), an Italian company. “Customer” refers to the customer who places the order on the Phonebuddy website.
“Terms” refers to these terms and conditions.
“Phonebuddy Warranty” refers to the commercial warranty that Phonebuddy provides for its mobile phones.

“Day” refers to a working day. Weekends and holidays are not considered working days.
“FMI” refers to the Find My iPhone feature in Apple iPhone.
“IMEI” refers to International Mobile Equipment Identity.

  1. Customer

By placing an order on the Phonebuddy website, Customer agrees to these Terms. When placing an order, Customer will be required to provide contact information, including name, billing and shipping address, active phone number, and email address. Customer will be solely responsible for the accuracy of the information provided to Phonebuddy and for any costs incurred as a result of providing incorrect information.

By placing an order on the Phonebuddy website, the Customer confirms that he/she is of legal age to accept these Terms and place an order on the Phonebuddy website.

Customer data is stored in Phonebuddy's customer register and used to manage and maintain relationships with the Customer. For more information on the processing of personal data, please see Phonebuddy's Privacy Policy, available on the Phonebuddy website.

  1. Products

Phonebuddy sells used and refurbished cell phones. Before being put on sale, the cell phones are checked and refurbished by Phonebuddy professionals. Phonebuddy classifies the cell phones based on their aesthetic characteristics. When the Customer places an order, he chooses the desired model, the color, the memory capacity and the condition category of the cell phone he wishes to purchase. The smartphones are used and refurbished, so Phonebuddy does not guarantee that the original certification of resistance to water and dust (IP67 or IP68 certification) remains valid.

We make every effort to accurately describe the features of all our products, including their condition and colors.

Repairs and replacements are performed using high-quality components, including third-party components. Due to the use of third-party components, the message “Non-genuine component identified” may appear on your phone. For more details about your device, please contact our customer service. All repairs are designed to restore the functionality of a new phone as much as possible.

If you purchased an iPhone XR, XS, or newer, you may see an “Important Message” or “Unknown Parts” alerts on your Lock screen, Notification Center, or Settings. These messages may appear when Phonebuddy has performed repair work on your device and parts need to be replaced. For more information, visit our Help Center.

  1. Prices

Product prices include value added tax (VAT), if applicable. Used mobile phones are often subject to the VAT margin regime.

Product prices do not include shipping costs. The cost of shipping is clearly communicated to the customer before placing the order and depends on the method chosen.

In the event of a clear and material pricing error, Phonebuddy reserves the right to cancel the order. Specifically, this refers to those cases in which the price of the product differs so substantially and clearly from the normal price level of the item that it is assumed that the average consumer has detected the error in question.

  1. Payment

Phonebuddy accepts the following payment methods:

  • Visa, Amex, Maestro, Mastercard – card payment
  • PayPal
  • Apple Pay
  • Google Pay
  • UnionPay
  • OPay

The terms and conditions of individual payment service providers apply to purchases made using their services. Phonebuddy reserves the right to deny and/or cancel any order. Additionally, should any payment complications arise on the part of the Customer, Phonebuddy reserves the right to cancel the sale and request the immediate return of the products.

  1. Delivery

The list of shipping methods currently available is available on the Phonebuddy website. When placing an order, the Customer must provide Phonebuddy and the carrier with correct information to enable successful delivery, such as the address and telephone number in the correct format.

The order is processed on average within 1-2 working days from the sending of the automatic order confirmation. The delivery time is generally between 1 and 5 working days. If the Customer chooses DHL Express delivery, the delivery time is normally between 1 and 3 working days. Weekends and holidays are not considered working days.

Delivery times are approximate and depend on the logistics provider. Phonebuddy will endeavor to process all orders within the timeframe stated above, where possible. However, Phonebuddy will not be liable for any delays in delivery caused by events beyond its reasonable control, including but not limited to incorrect information provided by the Customer when placing the order, strikes, adverse weather conditions, epidemics, quarantine or shortages of transportation fuel, electricity or labor.

If a customer receives an incorrect or damaged product, they must inform Phonebuddy of the matter within 72 hours of receiving the items. Phonebuddy reserves the right to request additional payment for the return of incorrect or damaged products.

  1. Returns

By law, the Customer has the right to return goods within 14 days. Phonebuddy guarantees a full refund for all returned products, provided that the products are returned in the same condition as when delivered. If the products are damaged in any way, Phonebuddy may return the products to the Customer or offer a repair service for a fee.

Phonebuddy will refund you, using the same method you selected for payment, as soon as possible and at the latest within 5 days of receiving your products. Occasionally, such as public holidays or other reasons, the refund may take longer. If Phonebuddy is unable to refund you using the same method you selected for payment, the refund will be made via an alternative method acceptable to you. If you return products to us from another country outside the EU, you are responsible for covering the total cost of shipping, including any customs duties that may apply.

Before returning the products to Phonebuddy, the Customer must carefully package the products and take adequate protective measures to avoid damage. The products must be sent to our address via the indicated courier and applying the methods specified in the instructions. The Customer will be responsible for the products until they have been delivered to Phonebuddy.

To make a return, the Customer must contact customer service at 347 719 67 68 - 081 278 58 09 - 3477196768, or by email at info@phonebuddy.it. The Customer must inform Phonebuddy of his intention to return the products within 14 days of receiving the products. The products must be returned to Phonebuddy within fourteen (14) days of communicating to Phonebuddy the Customer's intention to return the products.

Before sending a mobile phone to Phonebuddy, please ensure that the Find My iPhone (FMI) feature has been disabled. If Phonebuddy receives a mobile phone with the FMI feature enabled, Phonebuddy reserves the right to charge the Customer for any additional delivery charges and/or service fees. Additionally, refunds may be delayed due to the FMI feature being enabled. Phonebuddy reserves the right to return the phone if Find My iPhone cannot be disabled within one (1) month after notification by Phonebuddy. In this case, Phonebuddy will send the device back and will not refund the amount. If you do not collect the phone, Phonebuddy will not take any further responsibility for the device and it will be disposed of.

  1. Liability for defects

By law, the Customer is entitled to a 1-year legal warranty for the products purchased; this warranty starts from the date of delivery of the product. If the Customer detects, upon receipt of the products, defects that have not been caused by negligent use of such products, the Customer must inform Phonebuddy of this as soon as possible after having discovered them. The report to Phonebuddy must be made using the contact form available in our Help Center, by telephone or via the chat service on the Phonebuddy website. After having made the report and received instructions on how to proceed, the defective product must be sent to the specified address within a reasonable period of time, following the instructions for the delivery method and courier.

If the Customer receives a product that does not conform to specifications, the Customer must inform us within three (3) days of receiving the product.

Phonebuddy reserves the right to verify reported defects in products within 3-5 working days, before issuing any refund.

  1. Trade-in Terms and Conditions

For the terms and conditions applicable to your trade-in on the Phonebuddy website, contact customer service at 347 719 67 68 - 081 278 58 09 - 3477196768, or by email at info@phonebuddy.it.

  1. Limitation of liability

Nothing in these Terms shall exclude or limit Phonebuddy's liability in respect of any matter for which it would be unlawful to limit or exclude our liability.

The products are sold as is. Phonebuddy will not be liable for any indirect costs which are a side effect of the main loss or damage, for example loss of profits or opportunity, nor for any failure to deliver the products or to perform any of our other obligations under our Terms, if such failure is due to events beyond our reasonable control, including, but not limited to, fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity, strike, epidemic or quarantine. Phonebuddy's maximum financial liability to you for any loss or damage associated with your order on the Phonebuddy website will be limited to the total price of your order.

Product liability in the event of defects is limited to the possible refund of the purchase price of the product net of any benefits enjoyed.

Phonebuddy does not provide original purchase receipts from the first owner of the cell phone and is not obligated to do so.

Certain features or services available on phones sold by Phonebuddy may require you to open an Apple user account (including setting up an Apple user ID and password). You will be responsible for all activity on your account and for keeping your account information, including your password, secure. You may not use anyone else's Apple ID, password, or account under any circumstances without their consent and authorization as the account holder. Phonebuddy cannot and does not assume any liability for any loss or damage arising from your failure to comply with these responsibilities. Phonebuddy will not be liable for any forgotten Apple ID or password. If Phonebuddy is unable to access your phone to repair it or provide a refund because of a forgotten Apple ID or password, Phonebuddy will return the phone to you.

If there are any problems with the availability of goods in stock for reasons beyond the control of the company, Phonebuddy reserves the right to cancel the sale. In this case a full refund of the order will be issued.

The products are sold in accordance with the description on the site. By selecting the product condition, you expressly accept the characteristics described.

  1. Changes to Terms and Conditions

We reserve the right to change these Terms at any time without notice. The version of the Terms that applies to your order is the version available on the Phonebuddy website at the time of your order.

  1. Applicable law and dispute resolution

These Terms are governed by Italian law. If you have any complaints, please contact Phonebuddy at info@phonebuddy.it or +39 081 278 58 09 (Local charges apply. International charges apply for calls from other countries). If you are not satisfied with the solution that Phonebuddy has proposed to your complaint, you may file a complaint with your local consumer protection association . Alternatively, you may submit a complaint via the European Union's online dispute resolution portal.
